What information this website collects, how I use it, and the choices you have.

1. Overview

This Privacy Policy explains how I, Kyle D. Smith (operating Kyle D. Smith Mediations, a sole proprietorship), collect, use, and protect information when you visit kdsmediations.com (the “Site”) or contact me through it. By using the Site, you agree to this Policy.

2. Information I Collect

Information you provide. When you submit my contact or consultation form, or email me directly, I collect the information you choose to give me⁠—⁠typically your name, email address, phone number, the type of dispute, and any details you include in your message. My contact form is provided by a WordPress plugin that stores submissions in the website’s database.

Information collected automatically. Like most websites, my web server may log standard technical information such as your IP address, browser type, the pages you view, and the date and time of access. I use these logs to operate and secure the Site.

Cookies and analytics. I do not use advertising cookies, and the Site loads its fonts from my own server rather than from third parties. I may use a privacy-respecting analytics tool that collects only anonymized usage data about how visitors use the Site. WordPress may set strictly necessary cookies for me as the logged-in administrator only.

3. How I Use Information

I use the information I collect to respond to your inquiry and discuss whether mediation is appropriate; to schedule and provide my services; to operate, secure, and improve the Site; and to comply with my legal and record-keeping obligations. I do not sell your personal information.

4. Cookies and Tracking

Because I do not track visitors across third-party websites, I do not respond differently to “Do Not Track” browser signals. (California Business & Professions Code section 22575, known as CalOPPA, requires me to disclose this.) Any analytics I use collects only anonymized data.

5. How I Share Information

I share personal information only with the service providers who help me operate the Site and my practice⁠—⁠currently my website host (Cloudways), my email provider (Google Workspace), and the WordPress plugin that powers my contact form⁠—⁠and with authorities or other parties when required by law or to protect rights, property, or safety. If I use a scheduling tool to arrange sessions, I do not share confidential case details with it beyond what is necessary to schedule (for example, that a mediation is taking place). Email I receive through Google Workspace is maintained confidentially. I do not sell or rent personal information.

6. Data Retention

I keep inquiry information only as long as needed to respond to you and to meet my legitimate business and legal record-keeping needs, after which I delete or anonymize it.

7. Security

I take reasonable measures to protect personal information, including serving the Site over HTTPS and handling email confidentially. However, no method of transmission over the internet or method of storage is completely secure, so I cannot guarantee absolute security. Please avoid sending confidential case details through the Site⁠—⁠see my Confidentiality Statement.

8. Your California Privacy Rights

Depending on your circumstances and applicable law, you may have rights to request access to, correction of, or deletion of personal information I hold about you, and to learn how it is used. California’s “Shine the Light” law (Civil Code section 1798.83) and, where applicable, the California Consumer Privacy Act (as amended by the CPRA) provide certain rights. A solo practice like mine may fall below some of these laws’ applicability thresholds, but I will honor reasonable requests wherever I can. To make a request, contact me using the details below. I will not discriminate against you for exercising these rights.

9. Children’s Privacy

The Site is intended for adults and is not directed to children under thirteen. I do not knowingly collect personal information from children.

The Site may link to other websites whose privacy practices I do not control. Please review their policies before providing them with information.

11. Changes to This Policy

I may update this Policy from time to time. Changes take effect when posted, and the “Last updated” date above will reflect the most recent revision.
